1. User Eligibility and Account

1.1 Eligibility: Use of the Platform is available to any individual or entity. 1.2 Account Responsibility: You are responsible for maintaining the confidentiality of your account details, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. 1.3 Accurate Information: You agree to provide current, complete, and accurate information during the registration and to update such information to keep it current. 1.4 The Platform reserves the right to restrict or deny access to any user if required by law or if misuse is detected.

2. Products (Bandishes / Songs), Pricing, and Orders

2.1 Products: We reserve the right to discontinue or modify any Bandish / Song with its notation and lyrics without prior notice. 2.2 Accuracy of Information: We make every effort to present each notation accurately. We do not warrant that any uploaded notation or script is 100% accurate, complete, reliable, current, or error‑free. All such content reflects the individual perspective and work of the original creator. Members are solely responsible for the accuracy and legality of their uploaded notations, and other users should exercise their own judgment when using or relying on such content. 2.3 Pricing: Prices for all notations are displayed on the Platform and are subject to change without notice. All transactions are processed in Indian Rupees (INR). 2.4 Order Acceptance: Your order submission constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason. 2.5 Payment: You agree to pay the total amount for your order using the secure online gateways provided.

3. Delivery, and Cancellations

3.1 Delivery of Purchased Scripts: All scripts purchased through our platform will be made available immediately inside the member’s dashboard upon receipt of a successful payment notification from the payment gateway. 3.2 Non‑Cancellable Orders: Once a purchase has been completed, the order cannot be cancelled, refunded, or reversed. Members are encouraged to review their selections carefully before confirming payment.

4. Intellectual Property Rights (IPR) – Ownership

Company Property: Ownership of the software, platform, and notation writing method used to operate the service belongs exclusively to HriMahesh Arts and Promotion. All rights, title, and interest in the website, its design, features, and underlying technology remain with the company.

Member Property: Uploaded notations and musical compositions remain the sole intellectual property of the respective creator. The company does not claim ownership of member‑generated content.

License for Use: By adding a notation and storing on our server, the creator grants the company a limited, non‑exclusive license to store the content and, if explicitly shared and approved, to display it in the public library. This license does not transfer ownership and is revocable if the creator deletes or withdraws the content.

5. Prohibited Activities and User Conduct

5.1 You agree not to: * Upload, post, or distribute any content that is harmful, abusive, harassing, defamatory, vulgar, obscene, or illegal. * Violate the intellectual property rights or proprietary rights of others. * Misuse the Platform for fraudulent or malicious purposes, including transmitting viruses or other harmful code. * Interfere with the functioning of the Platform or introduce software, scripts, or manual methods to monitor, copy, or disrupt the Platform's operation. 5.2 Violation of these terms may result in the immediate termination of your access and potential legal action.

6. Disclaimers and Limitation of Liability

6.1 Disclaimer of Warranties: The Platform is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the operation of the Platform or the information, content, materials, or products included on the Platform. 6.2 Limitation of Liability: We shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages (including loss of profits, data, or goodwill) arising from your use or inability to use our Platform or Services.

8. Governing Law and Jurisdiction

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India. 8.2 Jurisdiction: Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Thane, Mumbai.
